If you complain about crime, but publicly support criminals, what do you suppose our kids think?

Prince George's County has a crime problem--just read the archives of these discussion groups.
But while many individual who post here complain about crime, many, including some of the same people, post messages praising criminal behavior by our elected officials.
Donna Edwards, Nat Exum, Ulysses Currie,  David Harrington, Marilynn Bland, Camille Exum, house majority leader Barve--all accused of or investigated for criminal behavior, and all supported by people here.
What are our children supposed to believe about what's right and what's wrong  when the adults keep praising people who break the law.  
Do we really want to keep reinforcing the message that it is acceptable, even good, to pick and choose which laws to obey and which to disobey?  That it is good to disobey the law if you disagree with it or think breaking the law supports some noble purpose?
How do we expect our children, especially the ones tempted by gang promises to right perceived wrongs, to obey the law when we allow our leaders--the ones who should be setting an example--to ignore the very laws they pass?

HB 1132 is a sneaky bill that circumvents the TRIM Property Tax Rate cap. 


When Jack Johnson tried to float a repeal of the Homestead Property Tax credit last month, he also had a back-up plan: HB 1132

HB 1132 has been sitting untouched for weeks, but now that the Soccer Stadium excitement is over, the SAME PEOPLE are SNEAKING in a tax increase over the last weekend when you aren't ready for it!!

HB 1132 looks uneventful - it lets the County spend WSTC Tax funds (Transit tax funds) on school busses. How bad is that? The intent is to raise the WSTC Tax rate A LOT in order to use the new funds to pay for the $100 million school bus cost - instead of using the money for TRANSIT  - its intended purpose. So, if the County is going to use WSTC money to pay for general County costs... what's the difference in raising the general County tax rate? Well, the difference is that TRIM is supposed to apply to the COunty rate and prevent run-ups in expenses. But Jack Johnson is working with Senator Muse and Delegate Griffith to pick your pocket while you aren't looking!

The WSTC tax applies to your property tax assessment. Right now, it is 2.6 cents. You see this tax on your property tax bill after the County, State, MNCPPC and Storm water  taxes. 

Only the County tax is subject to the TRIM limit. Thus, the County can circumvent TRIM by getting permission to raise the WSTC rate to whatever it wants. Jack is talking about raising it to 7.5 cents or higher! That's right, a 300% tax increase, and it doesn't even go to Transit. 

Also, this is on top of the Legislature having decided to take $60 million of your MNCPPC - (which you overpaid) - and GIVING it to the County to pay for its bloated budget. http://mlis.state.md.us/2009rs/billfile/hb1517.htm 

That's right, first they are going to take $60 million that you overpaid, and then they are going to raise your tax rate through the backdoor!


WRITE YOUR STATE LEGISLATORS BELOW: 

Tell them that you don't want to see the TRIM tax rate cap circumvented. 


Dear Legislator: 

I oppose HB 1132. It is dishonest to create a Transit Tax and then use the funds generated to pay for the general fund excesses of the County Executive. This is nothing more than a backdoor repeal of TRIM - which voters have repeatedly told you not to touch. Sneaking in a tax to circumvent TRIM in the last days of the session is NOT listening to voters. Tell Jack Johnson to balance his budget without raiding my wallet. Homeowners are suffering as much as anyone and we cannot afford more.

Not only is the MD Senate bill unethical, it probably violates Article 1, Section 10 of the U.S. Constitution,
No State shall . . . pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts. . .
But our representatives in Annapolis don't seem to care.  I wonder if they cross their fingers when they take their oaths of office.

In the real world when you cancel a conract signed in good faith you are obliged to honor it.  In the real world, if you do this, there are penalties, and unless this contract is somehow strangely drawn, I am sure there would be penalties for cancelling it.

We scream constantly about unethical behavior, but here is a proposed law with a new and interesting twist -- REQUIRE a governmental body to behave in an unethical manner?????????  And make no mistake -- cancelling a contract is UNETHICAL!

We agree the BOE shouldn't have signed the contract, but that does not mean that laws should be passed REQUIRING that the BOE behave in an unethical manner.  Furthermore, if they cancel the contract, whatever penalties that would involved would surely kick in.  So, no matter what it tried to do, the BOE won't get the  money -- because surely penalties would then be levied - and the levying of penalties is beyond the BOE's control.

If the state is planning to cut the BOE budget by $36 million dollars, then they need to not try to shift the blame for the budget shortfall onto the BOE.  But if this bill passes, the state will be able to say:

"If the BOE had done what we wanted, they would have $36 million more dollars.  The shorfall is their fault."

It is fair to say that if the BOE hadn't spent money on a headquarters building, there would be some more money available to spend on other things (more like $8 million???), and that has been agreed on by virtually everyone, but....that is accurate.   Setting the BOE up to take the fall for a $36 million shortfall in next year's budget is not.

We elected the BOE, not just the legislators.  We elected the BOE to run the schools, not the legislators.  When the BOE screws up, we the voters need to hold them responsible, but this legislation presents a very dangerous precedent -- if the BOE does something the legislature doesn't like, they will make funding contingent on the BOE undoing thier actions?

This is an incredibly bad policy precedent.  If that's the way we are going to do things, then just eliminate the BOE and let the legislature run the schools, because the BOE will never be able to make another decision or sign a contract without wondering whether some legislator who doesn't like the decision will try to undo it.

This kind of threatened action hurts the kids in the schools a whole lot more than buying a headquarters building.  The amount for the budget year being considered isn't remotely close to $36 million.

On the one hand, I opposed the school board's decision to spend $36 million on new offices.
But on the other hand, I am absolutely appalled by the double standard of our senators.
Over the past few years, members of both houses of the General Assembly have spend tens, perhaps hundreds, of millions of dollars--money we desperately need now--on luxury office improvements for themselves.  
Now these disgusting hypocrites are holding our children hostage as part of an extortionate scheme to prevent the school board from carrying out office improvements that are far more moderate than the Mike Miller palace in Annapolis.
But the voters of Prince George's County keep reelecting these people, so they must be doing what most of the voters want.

I just received the following amendment to the State Budget Bill 100, sponsored by the Prince George's State Senate Delegation. If approved by both houses and the conference committee, it may cut an additional $36 million directly from the basic funding formula for ALL PGCPS students.
Therefore, if PGCPS will receive $250-300 less to educate students.  $36 million also is equal to the 600 teachers, if they each received $60,000 in salary and benefits, or the about cost to pay all 8-900 bus drivers.
Please note that the senate already cut millions from PGCPS BUDGET earlier in the week. In addition, the County Executive is asking for an exemption from the Maintenance of effort which would cut another $22 -27 million if approved by the State Board.
What is the --- THE FOUNDATION PROGRAM
The Bridge for Excellence (BTE) in Public Schools Act, commonly referred to as "Thornton" was completely phased in by fiscal 2008.  School systems receive a basic per pupil funding amount through the FOUNDATION PROGRAM. Additional funding formulas provide supplemental aid for students with special needs – students with disabilities, students eligible for free and reduced price meals (FRPM), and students with limited English proficiency (LEP). One discretionary part of the formulas that was in the original BTE-the Geographical Cost of Education Index (GCEI) – has not been fully funded. State aid for student transportation also increases. Local jurisdictions receive broad flexibility in determining how to meet State goals for student achievement along with the enhanced funding. However, each school system is held accountable for achieving goals and student outcome measurements outline in its Comprehensive Master Plan, which is updated annually.
Simply put it is the minimum cost to educate all students, if the General Assembly had not already cut the formula amount during the 2007 Special Session.
Why $36 million? I can only speculate, so it is best that you  to ask the Senate President (who also represents part of Prince Georges and/or the PG Senate Delegation. (see contact information below)
I will add however, that $36 million appears to have something in common with the following:
- This is the same amount originally cut from the County portion of the PGCPS budget by the County Executive
- This also appears to be about the same amount approved to lease/purchase the new school office complex so they could consolidate many administrative functions including the Division of Academics in one location instead of several spread out over many miles.
Either way, it appears that some are attempting to mix money from operation cost that directly impacts the classroom, students and teachers, with Capital Budget funds use to build, maintain and operate quality facilities more efficiently and effectively.
What can you do - CONTACT THE PRINCE GEORGE'S SENATE DELEGATION NOW and ask them about the amendment below.
They may vote as early as Friday morning, 9 AM and it may go to the conference committee later in the day and/or over the weekend.

Comment: All Maryland elected officials swear a solemn oath to "support the Constitution of the United States" and to support the Constitution and laws of the State of Maryland. The Maryland Constitution also provides:
Art. 44 . That the provisions of the Constitution of the United States, and of this State, apply, as well in time of war, as in time of peace; and any departure therefrom, or violation thereof, under the plea of necessity, or any other plea, is subversive of good Government, and tends to anarchy and despotism.
Most of them routinely break their oaths, apparently believing that whatever end they seek justifies ignoring the rights of the people under the Federal and State Constitutions and any promises made to respect those rights. Sometimes the courts blow the whistle on their unconstitutional actions. Here is one such case.

A federal judge has stripped away a law putting limits on strip clubs in Prince George's County.

For years, government officials in the county have been trying to curtail the way adult entertainers perform in the county's strip clubs. In fact, a bill was drawn up that laid out some rules, such as no touching by the patrons. But on Thursday a judge said the bill went to far.

Thursday, U.S. District Judge Marvin Garbis ruled the bill unconstitutionally broad, adding that it would have punished the owners of FedEx field if players patted each other on the rear.
Most current members of the Prince George's House and Senate Delegations who were then in office broke their oaths and voted for this unconstitutional law.  No current members voted against it.  Delegates Barbara Frush, James Proctor, Joseph Vallario, and Michael Vaughn did not vote.

The chairman of the key committee considering the D.C. United stadium study bill said today that the Prince George's County Council's failure to take a final position on the item yesterday "jeopardizes the fate of the bill for this session."
Chairman of House Appropriations Norman H. Conway (D-Wicomico) noted that Council Chairwoman Marilynn Bland had indicated to him over the weekend that the council would take up issue. A majority of the council voted preliminarily last week to oppose the bill but Bland had told Conway she was hopeful the council would change its position.
But Bland recessed a meeting yesterday without holding the vote (read more in Ovetta Wiggins' item below.) Without that vote, Conway said he will not move forward with the bill. Though the bill got initial support from his committee on Monday, its staff had discovered an amendment to the bill made it unconstitutional so the committee must vote anew before it can proceed.
"We do not have a letter from the County Council," Conway said. "At this point, the bill will not go anywhere."
Bill sponsor Del. Melony G. Griffith (D-Prince George's) said she still hopes the council will take up the issue in coming days. She said she hopes citizens will convince the council they want to let the state fund a study to see if the stadium could bring economic development to the county.
"They say in the legislature, a day is like 1,000 years and 1,000 years is like a day," she said. "If that letter comes on the final day of the session, I will works as hard as I can to make sure Prince George's gets this information."
